Welcome to Posh Pricer! These Terms of Service ("Terms") govern your use of the Posh Pricer mobile application, website, and related services (collectively, the "Service"), owned and operated by Resellerlytics ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Posh Pricer is a software tool designed to assist online resellers by providing pricing insights, image analysis, and data analytics for platforms such as Poshmark and eBay. Posh Pricer is an independent service and is not affiliated with, endorsed by, or sponsored by Poshmark, eBay, or any other marketplace.

2. Accounts and Registration

To access certain features of the Service, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or suspect any security breaches related to the Service.

3. Subscriptions and Payments

Posh Pricer may offer free and paid tier services ("Pro" subscriptions).

• In-App Purchases: Subscriptions purchased via the Apple App Store or Google Play Store are subject to the payment terms and conditions of the respective platform.
• Billing: Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the renewal date.
• Cancellation: You can manage or cancel your subscription directly through your device's App Store or Play Store settings.
• Refunds: Refunds are handled exclusively by the platform (Apple or Google) from which you purchased the subscription, in accordance with their refund policies.

4. Acceptable Use and Restrictions

You agree strictly to the following usage rules. Violation of these rules may result in the immediate termination of your account without refund.

• No Abuse of Free Services: You may not attempt to circumvent usage limits (such as free search quotas) by uninstalling and reinstalling the app, creating multiple fake accounts, or using automation tools.
• No Scraping: You may not use bots, scrapers, spiders, or other automated means to access the Service or extract data.
• No Reverse Engineering: You may not decompile, reverse engineer, or attempt to derive the source code of the app.
• Lawful Use: You may not use the Service for any illegal purpose or to violate any laws in your jurisdiction.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Resellerlytics. The "Posh Pricer" name and logo are trademarks of Resellerlytics.

6. Third-Party Data and Services

• Marketplace Data: Our Service displays data retrieved from third-party sources. We do not guarantee the accuracy, completeness, or timeliness of this data. Pricing estimates are for informational purposes only.
• Service Availability: We rely on third-party APIs and services (including Firebase and Google Gemini). We are not responsible for interruptions caused by these third-party providers.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the fullest extent permitted by law, Resellerlytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
